The implementation of the Protocol for Gender-Sensitive Judging by the Labor Justice of 2nd Region
O caminho para a garantia da igualdade de gênero envolve ações de diversos organismos sociais. No âmbito do Poder Judiciário, a efetividade do princípio da igualdade de gênero requereu a construção pelo Conselho Nacional de Justiça de um novo conceito de julgamento com perspectiva de gênero para possibilitar que os magistrados pudessem julgar a partir de uma nova visão: a lente de gênero. Este artigo pretende refletir sobre o papel da Justiça do Trabalho, em especial do Tribunal Regional do Trabalho da 2ª Região (TRT2), na implementação do Protocolo para Julgamento com Perspectiva de Gênero do Conselho Nacional de Justiça – CNJ para enfrentar a violência de gênero com foco principal na mulher. Durante o artigo, serão apresentadas as razões que levaram o CNJ a implementar o protocolo, os principais pontos abordados, a visão dos Protocolos adotados pelo Tribunal Superior do Trabalho – TST e pelo Conselho Superior da Justiça do Trabalho – CSJT e por fim apresentar as sentenças proferidas pelo Tribunal Regional do Trabalho da 2ª Região que aplicam o Protocolo para Julgamento com Perspectiva de Gênero.
The path to guaranteeing gender equality involves actions by various social organizations. Within the Judiciary, the effectiveness of the principle of gender equality required the National Council of Justice to construct a new concept of judgment with a gender perspective to enable magistrates to judge from a new perspective: the gender lens. This article aims to reflect on the role of the Labor Courts, in particular the Regional Labor Court of the 2nd Region (TRT2), in implementing the National Council of Justice (CNJ) Protocol for Judgments with a Gender Perspective to confront gender-based violence with a primary focus on women. The article will present the reasons that led the CNJ to implement the protocol, the main points addressed, the vision of the Protocols adopted by the Superior Labor Court (TST) and the Superior Council of Labor Justice (CSJT) and finally present the judgments handed down by the Regional Labor Court of the 2nd Region that apply the Protocol for Judgment with a Gender Perspective.
