Work and Social Security: a necessary association
O presente artigo, por meio do método hipotético-dedutivo, busca analisar a associação imprescindível entre o trabalho e o principal instrumento de proteção social institucionalizado pela Constituição Federal de 1988, denominado seguridade social. Partindo das premissas que definiram a seguridade social como o melhor e mais atual mecanismo de proteção social criado desde a metade do século passado, pretende-se investigar e demonstrar a importância do olhar integrativo entre trabalhado e seguridade social, como forma de otimização da proteção, muitas vezes negligenciada pelo Estado brasileiro. Para tanto, serão destacados os elementos que definiram o estudo conhecido como “Plano Beveridge” e seu acolhimento pela Constituição Federal de 1988. Em seguida, serão detalhadas as premissas principiológicas do referido Plano e a centralidade do trabalho como pressuposto e regra norteadora para as diversas técnicas de proteção e serviços previstos no modelo beveridgiano. Por fim, será feita uma comparação entre o mundo do trabalho que estruturou o Plano Beveridge e a nova realidade atual, demonstrando a necessidade de se repensar a reestruturação do sistema brasileiro de seguridade social.
This article, using a hypothetical-deductive method and, as a research technique, a bibliographical review and analysis of legal norms, seeks to analyze the essential association between work and the main instrument of social protection introduced by the Federal Constitution of 1988, called social security. Starting from the premises that defined social security as the best and most current social protection mechanism created since the middle of the last century, we seek to investigate and demonstrate the importance of an integrative view between work and social security, as a way of optimizing protection, often neglected by the Brazilian state. The elements that defined the study known as the “Beveridge Plan” and its acceptance by the Federal Constitution of 1988 will be highlighted. Next, the principle premises of the Plan and the centrality of the work as a presupposition and guiding rule for the various techniques will be detailed. of protection and services provided for in the Beveridgian model. Finally, a comparison will be made between the world of work that structured the Plan and the new current reality, demonstrating the need to rethink the new reality of the labor market when thinking about the restructuring and reforms of the Brazilian social security system.
