The innovation of article 7A of the law on notaries and registrars in the desjudicialization process
O presente estudo é resultado da pesquisa por conteúdos acerca do processo da Desjudicialização. Para tanto, foi realizada uma pesquisa exploratória e bibliográfica com intuito de analisar os aspectos pontuados pelos principais autores da referida temática, tanto em livros quanto em artigos científicos. Atualmente, na legislação pátria, encontramos o artigo 7º e seus incisos, da lei dos notários e registradores, que chancelam a atuação do Tabelião como árbitro, mediador e conciliador ampliando o rol de contendas que podem sair da esfera judicial, e que possam ser dirimidos na esfera particular. Na interpretação das leituras em livros, artigos constatou-se os seguintes dados: A atuação do tabelião está implementada de acordo com a necessidade concreta da sociedade, vindo esta figura, e suas funções, somar na busca da resolução de conflitos de forma célere e eficaz, não precisando, as partes, se socorrerem do poder judicial.
The present study is the result of a research for contents about the desjudicializatioon process. To this end, an exploratory and bibliographic research was carried out in order to analyze the aspects pointed out by the main authors of the referred theme, both in books and in scientific articles. Currently, in the national legislation, we find article 7 and its subsections of the Notaries and Registrars Law, which endorse the performance of the Notary as an arbitrator, mediator and conciliator, expanding the list of disputes that can leave the judicial sphere, and that can be settled in the private sphere. In the interpretation of the readings in books, articles, the following data were found: The performance of the notary is implemented according to the concrete needs of society, and this figure, and its functions, add to the search for the resolution of conflicts in a quick and effective way, and the parties do not need to resort to the judiciary.
